Another Federal Judge Finds Against CDC Eviction Moratorium

Last week (March 10, 2021) a federal judge in Ohio ruled that the CDC’s eviction order is unlawful. This comes just a couple of weeks after the ruling in Texas in which a federal judge ruled against the CDC as well. The decisions against the CDC for completely different reasons, so hopefully that will cause the administration to think twice about extending the order due to expire March 31. The Department of Justice has already appealed the Texas ruling and did make it clear it disagrees with the Ohio judgment; the DOJ also insists the ruling only applies to the parties to the cases, so for now it offers no relief to the rest of the landlord community.
